September 5, 2017:

The Fremont County Board of Supervisors met in regular session on Tuesday, September 5, 2017, in the Fremont County Courthouse Boardroom, with Hendrickson, Hickey, and Graham present.  A quorum was declared and the meeting officially called to order at 9:00 a.m. Minutes of the previous board session were read and approved. The agenda was approved as posted. 

Let the records show that Sandy Parmenter with the Valley News was present for this meeting. 

Mike Crecelius, EMC, met with the board for the signing of a resolution adopting the Fremont County Multi-Jurisdictional Hazard Mitigation Plan. Motion made by to sign resolution 2017-49. Motion carried unanimously.

RESOLUTION 2017-49

ADOPTING THE FREMONT COUNTY MULTI-JURISDICTIONAL HAZARD MITIGATION PLAN FOR UNINCORPORATED FREMONT COUNTY, IOWA,

WHEREAS, Fremont County has completed its portion of the Multi-Jurisdictional Hazard Mitigation Plan; and,

WHEREAS, review of the Hazard Mitigation Plan was open to the public; and,

WHEREAS, Fremont County has reviewed the recommendations of the Hazard Mitigation Plan and is in agreement with the priorities contained herein.

NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Fremont County hereby adopts the Fremont County Multi-Jurisdictional Hazard Mitigation Plan, as amended by Federal Emergency Management Agency for approval, as the guiding document for hazard mitigation in the city.

Troy Housh, Maintenance, met with the board regarding the repair of the doorway of the tunnel on the east side of the courthouse. Midwest Structural Repair came out to look at the issue and stated that it was not structural. It appears damage may be due to water leaking in over the years. Their estimate to repair the doorway is $3,500. Motion made by Graham to approve the repair of the tunnel entrance. Motion carried unanimously. 

Howard Nelson, Weed Commissioner, met with the board to discuss a new noxious weed that was added to the list of Primary Noxious Weeds in the Iowa Weed Law, Iowa Code Chapter 317. The weed is palmer amaranth. The Iowa Department of Agriculture and Land Stewardship have it reported in Hamburg. Nelson stated that he saw it not only in Hamburg, but in other areas of the county. The board will sign a resolution next week declaring this a noxious weed. It will then be added to the yearly resolution by the board. 

Dan Davis, Engineer, met with the board for two signings. Motion made by Hickey to allow Chairman Hendrickson to sign the payment voucher with HGM Associates for engineering services for J-34 over Mule Slough Bridge replacement Project #BRS-CO36(76) - - 60-36. Motion carried unanimously. 

Motion made by Hickey to allow Chairman Hendrickson to sign a temporary easement purchase agreement with Shelley Anne Fuhr on Project #STP-S-CO36(75) - - 5E-36 (Thurman Sidewalk Project). Motion carried unanimously. 

Auditor Owen spoke to the board regarding a campaign by the Iowa Secretary of State’s Office to proclaim September as National Voter Registration Month. Other efforts from the Secretary of State include a soft rollout of the voter identification requirement law that will be in effect on January 1, 2018, during the upcoming school and city elections this fall. The Secretary of State’s Office has also created trading cards with super heroes to promote voter registration and voting to the younger generations. Motion made by Hickey to allow Chairman Hendrickson to sign the proclamation declaring September National Voter Registration Month. Motion carried unanimously. 

In other business, claims were approved for September 8, 2017

September 12, 2017:

The Fremont County Board of Supervisors met in regular session on Tuesday, September 12, 2017, in the Fremont County Courthouse Boardroom, with Hendrickson, Hickey, and Graham present.  A quorum was declared and the meeting officially called to order at 9:00 a.m. Minutes of the previous board session were read and approved. The agenda was approved as posted. 

Motion made by Hickey to approve the following resolution regarding a new noxious weed in Fremont County. Motion carried unanimously.

RESOLUTION NO.  2017-50

BE IT HEREBY RESOLVED by the Fremont County Board of Supervisors this 12th day of September, 2017, that the following order for destruction of noxious weeds be effective immediately.

 1. That each owner and each person in the possession or control of any land in Fremont County shall cut, burn, spray, or otherwise destroy all noxious weeds thereon and shall prevent weed seeds from blooming or coming to maturity, and shall keep said lands free from such growth of any other weeds as shall render the streets or highways adjoining said land unsafe for public travel.

Noxious weeds shall be cut, burned, sprayed, or otherwise destroyed on or before the following dates and as often thereafter as is necessary to prevent seed productions:

Group 3: August 1, 2017- for Palmer amaranth

2. That each owner and person in the possession or control of any lands in Fremont County, infested with any noxious weeds, including palmer amaranth shall adopt a program of weed destruction described by the Weed Commissioner, which in five years may be expected to destroy and will immediately keep under control such infestations of said noxious weeds.

3. That if the owners or persons in possession/control of any land in Fremont County fail to comply with the foregoing order, the Weed Commissioner shall cause this to be done and the expense of said work, including costs of serving notice and other costs, if any, to be assessed against the land and the owners thereof.

Engineer Dan Davis met with the board for the approval of the following. Motion made by Hickey to allow Chairman Hendrickson to sign the payment voucher for McClure Engineering Company on Project #BRS-CO36(74) - - 60-36, box replacement over Plum Creek. Motion carried unanimously. 

The monthly report for the Recorder’s Office for August was approved. 

Claims were approved for September 15, 2017

September 15, 2017:

The Fremont County Board of Supervisors met in special session on Friday, September 15, 2017, in the Fremont County Courthouse Boardroom, with Hendrickson, Hickey, and Graham present.  A quorum was declared and the meeting officially called to order at 9:00 a.m. The agenda was approved as posted. 

The Board of Supervisors concurring with the County Auditor, held the Official canvass of votes cast in the September 12, 2017, School Election. Motion made by Graham, carried unanimously, to declare the following people elected to their respective school boards:

September 19, 2017:

The Fremont County Board of Supervisors met in regular session on Tuesday, September 19, 2017, in the Fremont County Courthouse Boardroom, with Hendrickson and Hickey present.  Graham was not present at the start of the meeting. A quorum was declared and the meeting officially called to order at 9:00 a.m. Minutes of the previous board session were read and approved. The agenda was approved as posted. 

Let the records show that Sandy Parmenter with the Valley News was present for this meeting. 

Motion was made by Hickey to appoint Gloria Mattice to fill a vacancy on the Board of Health for the remainder of a 3-year terms expiring December 31, 2017. Motion carried unanimously. 

Motion made by Hendrickson to approve the following resolution appointing Lonnie Shanno as part-time seasonal help for the golf course at the request of the Conservation Board. The start date of employment is September 18, 2017.  Motion carried unanimously.

RESOLUTION NO. 2017-51

BE IT HEREBY RESOLVED by the Fremont County Board of Supervisors this 19th day of September 2017, that Lonnie Shanno shall be appointed as golf course part-time seasonal help, as requested by Fremont County Conservation Board.  The rate of pay shall be $8.83 per hour. The effective date of employment shall be September 18, 2017.

Laura Shafer, Co-Regional Captain, met with the board regarding a Bible reading on the courthouse lawn. This is in response to a Governor’s Proclamation encouraging Bible readings in front of courthouses in all 99 counties in Iowa. The dates have not been confirmed at this time. Motion was made by Hickey to approve the use of the courthouse lawn for the readings. Motion carried unanimously. 

Engineer Dan Davis met with the board regarding re-appointing Staci Scroggie as a member of the Board of Adjustment. Motion made by Hickey to sign the resolution reappointing her to a 5-year term. Motion carried unanimously.

RESOLUTION NO. 2017-52

BE IT HEREBY RESOLVED by the Fremont County Board of Supervisors this 19th day of September, 2017, that Staci Scroggie be reappointed to the Fremont County Board of Adjustment for a five year term, ending April 30, 2022.

Motion to approve made by Hickey, seconded by Hendrickson, carried unanimously.

Motion made by Hickey to allow Chairman Hendrickson sign the following resolution regarding the community development block grant for the watershed approach project. Motion carried unanimously.

RESOLUTION 2017-53

FOR JOINT AGENCY AGREEMENT

BY AND BETWEEN FREMONT COUNTY, IOWA AND OTHER COUNTIES

POTENTIALLY AFFECTED BY AN IOWA WATERSHED APPROACH PROJECT FUNDED THROUGH A COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) PROGRAM ALLOCATION FROM THE CATALOG OF FEDERAL DOMESTIC ASSISTANCE (CFDA) # 14.27 UNDER CONTRACT 13-NRDI-004

     WHEREAS, Fremont County, Iowa has been awarded “pass-through” funding by the Iowa Economic Development Authority (IEDA), from the Community Development Block Grant (CDBG) Program of the U.S. Department of Housing and Urban Development (HUD), to plan and implement improvements proposed for enhancement of the West Nishnabotna Watershed; and

     WHEREAS, as grantee, Fremont County is designated “Responsible Entity” to ensure compliance with federal provisions stipulated to be invoked by the National Environmental Policy Act, whereby an environmental review must be undertaken to determine whether proposed improvements may significantly affect the environment, and, if necessary, any mitigating actions must be taken; and

     WHEREAS, as Responsible Entity, Fremont County is likewise lead entity in association with planning and development activities proposed within jurisdiction of the West Nishnabotna Watershed subject to environmental review; and

     WHEREAS, Fremont County may not independently exercise responsibilities required by environmental review on behalf of another county without joint approval through mutual agreement, now therefore,

     BE IT RESOLVED BY THE PARTIES HERETO THAT the Responsible Entity is hereby authorized to determine activities and any mitigating actions to be implemented for watershed improvement(s) within Fremont County.

IN WITNESS WHEREOF, the Parties hereto have caused this Agreement to be executed by their duly authorized representatives.

Motion made by Hickey to approve the class C, native wine, living quarters, outdoor service, and Sunday sales liquor license for Finders Keepers Antique Mall and Coffee Shop. Motion carried unanimously. 

At 9:13 a.m., Supervisor Graham joined the meeting. 

The Sheriff’s Office monthly report was approved for August 2017.  

Claims were approved for September 22, 2017

September 26, 2017:

The Fremont County Board of Supervisors met in regular session on Tuesday, September 26, 2017, in the Fremont County Courthouse Boardroom, with Hendrickson & Hickey present. Graham was not present for this meeting.  A quorum was declared and the meeting officially called to order at 9:00 a.m. Minutes of the previous board session were read and approved. The agenda was approved as posted. 

Let the records show that Sandy Parmenter with the Valley News Today was present for this meeting. 

Motion was made by Hickey to approve the TIF reporting requirement to Department of Management.  Motion carried unanimously. 

Pilot Travel Center expressed through an email to the Auditor’s Office that they would like to apply for an off-premise liquor, beer, and wine permit. They just wanted this message relayed to the board to see if there were any problems in doing this. They currently have an off-premise beer permit. The board saw no issue with them applying for the permit. 

Motion made by Hickey to approve the renewal of the Class C/Sunday Sales Beer Permit for The Junction (Cubby’s). Motion carried unanimously. 

Claims were approved for September 29, 2017.
