January 2, 2018:

The Fremont County Board of Supervisors met in regular session on Tuesday, January 2, 2018, in the Fremont County Courthouse Boardroom, with Hendrickson and Graham present.  Let the records show that Hickey was not present for this meeting. A quorum was declared and the meeting officially called to order at 9:00 a.m. Minutes of the previous board session were read and approved.  The agenda was approved as posted. 

Also present were Matt and Nick Shearer and Sandy Parmenter with the Valley News Today. 

The board approved the following resolutions to reorganize the board for 2018:

RESOLUTION NO. 2018-1

WHEREAS, motion was made by Hendrickson to appoint Randy Hickey, Board Chairman and Terry Graham as Board Vice Chairman.

WHEREAS, the Board Chairman may make motions and vote as any other member of the Board.

BE IT HEREBY RESOLVED by the Fremont County Board of Supervisors this 2nd day of January, 2018, that Supervisor Hickey is appointed Board Chairman and Supervisor Graham is appointed to the position of Vice-Chairman.

RESOLUTION NO.  2018-2

BE IT HEREBY RESOLVED by the Fremont County Board of Supervisors this 2nd day of January, 2018, that the 2018 committee appointments are as follows:

RESOLUTION NO. 2018-3

BE IT HEREBY RESOLVED by the Fremont County Board of Supervisors this 2nd day of January, 2018, that the Board will hold its regular meetings on Tuesday of each week in the office of the Fremont County Courthouse, Sidney, Iowa, commencing at 9:00 a.m. until business is concluded.

Motion made by Hendrickson to reappoint Graham to the SWIPCO Policy Council.  

Motion carried unanimously. Motion made by Hendrickson to table the appointment of the alternate and the member of the public. Motion carried unanimously.

Motion carried unanimously. 

Matt Shearer and Nick Shearer met with the board regarding a septic tank issue at 1988 300th Avenue in Sidney. Let the records show that EMC Mike Crecelius joined the meeting. The board previously discussed this at their meeting on October 31st. Shearers have now installed a new septic system including laterals. The laterals were not originally installed at the proper distance. When they tried to sell the house, it failed the inspection due to this and the fact that the tank had collapsed. This matter was turned over to the county’s insurance company and the claim denied. Graham stated that he would talk to the insurance company about this matter as he believes the county is at fault. Hendrickson believes both parties are at fault. Graham stated that he will speak to the insurance company regarding the matter. 

Motion made by Graham to approve the new temporary light duty and prescription and medication policies submitted by INCS. Motion carried unanimously.  

Claims were approved for January 5, 2018

January 9, 2018:

The Fremont County Board of Supervisors met in regular session on Tuesday, January 9, 2018, in the Fremont County Courthouse Boardroom, with Hickey, Graham, and Hendrickson present.  A quorum was declared and the meeting officially called to order at 9:02 a.m. Minutes of the previous board session were read and approved.  The agenda was approved as posted. 

Also present was Sandy Parmenter with the Valley News Today. 

Motion was made by Hendrickson to approve the Treasurer’s Semi-Annual Report.  Motion carried unanimously. 

Motion made by Graham to appoint Hendrickson as an alternate member to the SWIPCO Policy Council. Motion carried unanimously. 

Veteran’s Affairs Director Carlene Hall and Veteran’s Affairs Commission Member Cal Roulson met with the board to discuss upcoming funding cuts from the state. Hall informed the board that no dollars have been spent on direct services for veterans. Funding was cut to $9,700 last year and there is a possible decrease of 50% for the coming year. These dollars are currently used for salary. Hall doesn’t think this is being used as intended. She wants to develop an outreach program and this would require more hours. She would like to revisit how the money is allocated this budget time. Graham requested that research be done as to how other counties spend those funds. There have been 756 veterans reached in Fremont County. There are more than 300 that she estimated that she has yet to reach. She has two experienced members of the association that would be willing to come speak to the board about how they handle these funds. Cal Roulson thanked the board for their service and stated that he and the commission were pleased with Carlene and Nancy’s efforts in the office. 

In other business, the Recorder’s Monthly Report for December was approved.

January 16, 2018:

The Fremont County Board of Supervisors met in regular session on Tuesday, January 16, 2018, in the Fremont County Courthouse Boardroom, with Hickey and Hendrickson present.  Let the record show that Graham was not present for the start of this meeting. A quorum was declared, and the meeting officially called to order at 9:00 a.m. Minutes of the previous board session were read and approved.  The agenda was approved as posted. 

Also present for this meeting were Treasurer Alise Snyder and Sandy Parmenter from the Valley News Today. 

Let the record show that Brian Kingsolver with FREDCO was not present for this meeting. 

Auditor Owen spoke to the board regarding the county held tax certificate process. In speaking to other counties, they do not publish or hold a public hearing to assign the county held tax sale certificates. They assign them by a simple motion in a regular meeting. This would save the county money for the publications and time for the purchasers. Treasurer Snyder would like the board to continue signing the resolutions for a paper trail on the assignments.  

Engineer Dan Davis and Purchasing Agent Jeff Shirley met with the board regarding two items. They would like to purchase two utility boxes for crew trucks. Shirley provided pictures of one of the boxes to show the damage. Both boxes to be replaced are damaged. Motion made by Hendrickson to allow the purchase of two utility boxes. Motion carried unanimously. 

Motion made by Hendrickson to allow Chairman Hickey to sign final payment voucher for Project # STP-S-CO36(65) - - 55-36 (J-18). Motion carried unanimously. 

Auditor Owen presented a 28E Agreement for Iowa Precinct Atlas Consortium. This is a computer program to assist the poll workers at the polling place on election day. Poll workers will use the program to check voters in, verify their registrations, and process their registrations. The program is now run by ISAC. The office has been looking at this program and one offered by the Secretary of State for years. With the upcoming combination of city and school elections due to legislation, this will be an easier way to issue ballots since there will be multiple ballot styles at each location. Motion made by Hendrickson to sign the 28E agreement with ISAC and the Precinct Atlas Consortium. Motion carried unanimously.  

Let the records show that Nathan Summers with DA Davidson was not present for this meeting due to a family emergency. 

At 9:24 a.m., Supervisor Graham joined the meeting.  

A public hearing was held for Assignment of Certificate of Purchase at Tax Sale Certificate. At 10:02 a.m., motion was made by Hendrickson to go into Public Hearing to approve an Assignment of Certificate of Purchase at Tax Sale.  Motion carried unanimously. 

At 10:04 a.m., with no one present from the public, motion was made by Hendrickson to go out of public hearing and approve the following Resolutions regarding the Certificate of Purchase at Tax Sale.  Motion carried unanimously.

RESOLUTION NO. 2018-6

RESOLUTION APPROVING THE ASSIGNMENT OF CERTIFICATE OF PURCHASE AT TAX SALE TO THE FOLLOWING:

WHEREAS, Terry and Luanna Kennedy, 809 Alice Avenue, Riverton Iowa, 51650, are desirous of obtaining a certificate of tax sale purchase for $313.00 for the following: 

Parcel Number 460460139000000, Tax Sale Certificate number 2015-315 – Lot 798 in the Town of Riverton, Fremont County, Iowa, according to the recorded plat thereof.  

WHEREAS, Fremont County is desirous of avoiding the expense of tax redemption procedure, and

WHEREAS, a public hearing on this proposal was held on the 16th of January, 2018, and,

WHEREAS, the transfer of said certificate of tax purchase to the Terry and Luanna Kennedy, 809 Alice Avenue, Riverton, IA, 51650, is in the better interest of the County and is in the better interest of Terry and Luanna Kennedy to eliminate any form of liability to Fremont County, now

THEREFORE, it is hereby resolved that the Chairman of the Board of Supervisors is authorized and directed to execute the assignment of certificates of tax purchases of this real estate upon receipt of payment.

RESOLUTION NO. 2018-7

ASSIGNMENT OF CERTIFICATE OF TAX SALE PURCHASE

Fremont County does hereby transfer the certificate of tax sale purchase regarding the described real estate to Terry and Luanna Kennedy, 809 Alice Avenue, Riverton, Iowa, 51650, as follows:

Lots 798, in the Town of Riverton, Fremont County, Iowa, according to the recorded plat thereof.  

The county shall endorse the tax sale certificate as necessary to complete this assignment upon receipt of payment of $313.00.

January 23, 2018:

The Fremont County Board of Supervisors met in regular session on Tuesday, January 23, 2018, in the Fremont County Courthouse Boardroom, with Hickey, Graham, and Hendrickson present. A quorum was declared, and the meeting officially called to order at 9:00 a.m. Minutes of the previous board session were read and approved.  The agenda was approved as posted. 

Also present was Sandy Parmenter with the Valley News Today. 

At 9:05 a.m. the board canvassed the 2018 Drainage Elections held on January 20th, 2018. Motion made by Hendrickson to approve the results. Motion carried unanimously. 

Nathan Summers with DA Davidson met with the board. They offer financial services and wanted to let the board know their services are available if a bond is necessary for emergency communications. They are currently working with Montgomery County on their radio project. 

Robert Bailey with Liberty National Life met with the board regarding his company’s life insurance plans and what they offer. The group term policy is portable. The board will consider the plans at a later date. 

Engineer Dan Davis met with the board for the signing of IDOT Payment Voucher with HGM Associates for Engineering Services on J-24, Project # STP-S-CO36(75) - - 5E-36. Motion made by Hendrickson to allow Chairman Hickey to sign the payment voucher. Motion carried unanimously. 

Motion was made Hendrickson to allow Chairman Hickey to sign GAX fund request for payment under CDBG for the Iowa Watershed Approach project. Motion carried unanimously. 

The board discussed the disbursement of the hotel/motel tax. Graham discussed the need of fundraising events in the county for tourism.  

Claims were approved for January 26, 2018

January 30, 2018:

The Fremont County Board of Supervisors met in regular session on Tuesday, January 30, 2018, in the Fremont County Courthouse Boardroom, with Hickey, Graham, and Hendrickson present. A quorum was declared, and the meeting officially called to order at 9:00 a.m. Minutes of the previous board session were read and approved.  The agenda was approved as posted.

Motion was made by Graham to approve the following Resolution 2018-8.  Motion carried unanimously.

RESOLUTION 2018-8

CONSTRUCTION EVALUATION RESOLUTION

WHEREAS, Iowa Code section 459.304(3) sets out the procedure if a board of supervisors wishes to adopt a “construction evaluation resolution” relating to the construction of a confinement feeding operation structure; and

WHEREAS, only counties that have adopted a construction evaluation resolution can submit to the Department of Natural Resources (DNR) an adopted recommendation to approve or disapprove a construction permit application regarding a proposed confinement feeding operation structure; and WHEREAS, only counties that have adopted a construction evaluation resolution and submitted an adopted recommendation may contest the DNR’s decision regarding a specific application; and WHEREAS,  by adopting a construction evaluation resolution the board of supervisors agrees to evaluate every construction permit application for a proposed confinement feeding operation structure received by the board of supervisors between February 1, 2018, and January 31, 2019, and submit an adopted recommendation regarding that application to the DNR; and  WHEREAS,  the board of supervisors must conduct an evaluation of every construction permit application using the master matrix created in Iowa Code section 459.305, but the board’s recommendation to the DNR may be based on the final score on the master matrix or may be based on reasons other than the final score on the master matrix; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF FREMONT COUNTY that the Board of Supervisors hereby adopts this construction evaluation resolution pursuant to Iowa Code section 459.304(3).

Motion made by Hendrickson to allow Chairman Hickey to sign change in CEO Form for East Nishnabotna Watershed Project at SWIPCO’s request. Motion carried unanimously. 

Motion made by Hendrickson to allow Chairman Hickey to sign environmental signature pages for East Nishnabotna Watershed Project at SWIPCO’s request. Motion carried unanimously. 

Motion made by Hendrickson to allow Chairman Hickey to sign contract amendment for East Nishnabotna Watershed Project at SWIPCO’s request. Motion carried unanimously. 

Harvey Moyer came to see the board regarding a property in Percival that he was previously in on January 3, 2017, to discuss. Chairman Hickey told Moyer that the county attorney has the paperwork complete. It needs to be filed with the treasurer and then the 90-day process will begin. 

Assistant Engineer Robbie Kromminga met with board for a signing of IDOT final progress voucher with Western Engineering for baseline road, Project #FM-CO36(73) - - 55-36. Motion made by Hendrickson to allow Chairman Hickey to sign the progress voucher. Motion carried unanimously. 

Mental Health Advocate Kathy Beam met with the board regarding a wage increase. She has not had an increase since 2014. Graham ran figures to show what the sheriff’s office and roads received the last two years. With those figures, Beam’s wage would raise to $17.54 per hour beginning July 1, 2018. She averages around 50 hours per year. Motion made by Hickey to approve the wage increase for Kathy Beam. Motion carried unanimously.

The Fremont County Board of Supervisors met in special session on Tuesday, January 30, 2018, in the Mills County Courthouse Boardroom, with Hickey and Hendrickson present. A quorum was declared, and the meeting officially called to order at 1:02 p.m. The agenda was approved as posted. 

Also present were Nick Johnson from the Mills County Attorney’s Office, Adam Rupe and George Parris from JEO, Grant Anderson from MAPA, the Mills County Supervisors Carol Vinton, Lonnie Mayberry, and Richard Crouch, and Mills County Auditor Carol Robertson. 

Cara Morgan with Golden Hills RC & D met with the Fremont and Mills County Boards regarding the signing of the contract with JEO Consulting Group, Inc., for planning services on the East & West Nishnabotna Watershed Management and Flood Resiliency Plan. She explained that there were two contracts, one for each county with JEO. Exhibit 1, the scope of work, was the same for both counties. Mills County Attorney’s Office reviewed the documents prior to the meeting.  

Motion made by Hickey to sign the contract with JEO. Motion seconded by Hendrickson. Motion carried unanimously. 

Motion made by Mayberry to sign the contract with JEO. Motion seconded by Vinton. Motion carried unanimously. 

Also discussed with MAPA was the work that was performed by the various offices in administering this project. There was discussion as to whether the counties could submit invoices for their time spent on the project. Anderson said he thought that if they could come up with figures they could be submitted and possibly paid through the administration or planning and project funds. 

At 1:32 p.m., there being no further business, Hickey made a motion to adjourn. Motion carried unanimously.
