July 2018

July 3, 2018:

The Fremont County Board of Supervisors met in regular session on Tuesday, July 3, 2018, in the Fremont County Courthouse Boardroom, with Hickey, Graham, and Hendrickson present. A quorum was declared, and the meeting officially called to order at 9:00 a.m. The agenda was approved as posted. Minutes of the previous board session were read and approved. 

Let the records show that Sandy Parmenter from the Valley News Today was present for this meeting. 

Motion made by Hendrickson to allow Chairman Hickey to sign a business agreement with Iowa County Technology Services. Motion carried unanimously. 

Motion made by Hendrickson to grant an extension for a nuisance abatement in Bartlett until October 1, 2018.  Assistant Engineer Robbie Kromminga was present and stated that there has been some progress made at the location as of yesterday. Motion carried unanimously. 

The board received a letter regarding a nuisance abatement notice in McPaul on 6/28/18. The board discussed the letter. In the letter, the complainant disagrees with the notice that he received. The board agreed to proceed with the action against the homeowner. Kromminga stated he has been out checking properties and would take the next steps in the process. 

The board discussed county held tax certificate 2018-306. Kevin and Lori Burge are interested in purchasing the certificate. Motion made by Hendrickson to approve the following assignment of certificate of purchase at tax sale resolution and resolution of assignment of certificate of tax sale purchase. Motion carried unanimously.

RESOLUTION NO. 2018-36

RESOLUTION APPROVING THE ASSIGNMENT OF CERTIFICATE OF PURCHASE AT TAX SALE TO THE FOLLOWING:

WHEREAS, Kevin and Lori Burge, 3179 Main ST, Hamburg, Iowa, 51640, are desirous of obtaining a certificate of tax sale purchase for $268.00 for the following: 

Parcel Number 460460079010000, Tax Sale Certificate number 2018-306 – Lots 607 through 609 in the Town of Riverton, Fremont County, Iowa, according to the recorded plat thereof.  

WHEREAS, Fremont County is desirous of avoiding the expense of tax redemption procedure, and

WHEREAS, the transfer of said certificate of tax purchase to Kevin and Lori Burge, 3179 Main ST, Hamburg, Iowa, 51640, is in the better interest of the County and is in the better interest of Kevin and Lori Burge to eliminate any form of liability to Fremont County, now

THEREFORE, it is hereby resolved that the Chairman of the Board of Supervisors is authorized and directed to execute the assignment of certificates of tax purchases of this real estate upon receipt of payment.

RESOLUTION NO. 2018-37

ASSIGNMENT OF CERTIFICATE OF TAX SALE PURCHASE

Fremont County does hereby transfer the certificate of tax sale purchase regarding the described real estate to Kevin and Lori Burge, 3179 Main ST, Hamburg, Iowa, 51640, as follows: Lots 607 through 609, in the Town of Riverton, Fremont County, Iowa, according to the recorded plat thereof. The county shall endorse the tax sale certificate as necessary to complete this assignment upon receipt of payment of $268.00.

Becky Shull met with the board regarding an upcoming tournament fundraiser for the Fremont County Golf Course on July 8, 2018. She asked that the green fees be waived as has been done in the past for the participants because this tournament specifically benefits the golf course. The funds raised will go into the Ladies Association account and they will donate to make improvements if they are approved by the conservation board. Motion made by Graham to waive the green fees for the tournament fundraiser on July 9th. Motion carried unanimously. 

Claims were paid for July 6, 2018

July 10, 2018:

The Fremont County Board of Supervisors met in regular session on Tuesday, July 10, 2018, in the Fremont County Courthouse Boardroom, with Hickey, Graham, and Hendrickson present. A quorum was declared, and the meeting officially called to order at 9:00 a.m. The agenda was approved as posted. Minutes of the previous board session were read and approved. 

Let the records show that Sandy Parmenter from the Valley News Today was present for this meeting. Also present for this meeting was Conrad Hall. 

Motion made by Hendrickson to allow Chairman Hickey to sign the single audit form required for the CDBG funding. Motion carried unanimously. 

Motion made by Graham to approve the following Resolution 2018-38 regarding noxious weeds.  Motion carried unanimously.

RESOLUTION NO.  2018-38

BE IT HEREBY RESOLVED by the Fremont County Board of Supervisors this 10th day of July 2018, that the following order for destruction of noxious weeds be effective immediately.

 1. That each owner and each person in the possession or control of any land in Fremont County shall cut, burn, spray, or otherwise destroy all noxious weeds thereon and shall prevent weed seeds from blooming or coming to maturity, and shall keep said lands free from such growth of any other weeds as shall render the streets or highways adjoining said land unsafe for public travel. Noxious weeds shall be cut, burned, sprayed, or otherwise destroyed on or before the following dates and as often thereafter as is necessary to prevent seed productions:

Group 1: June 1, 2018 - for Leafy Spurge, Perennial Peppergrass, Sour Dock, Sheep Sorrow, Canada Thistle, Russian Knapweed, Buckhorn, Wild Mustard, Musk Thistle, Bull Thistle, and all other species of thistle
Group 2: July 1, 2018 - for Field Bindweed, Wild Carrot
Group 3: August 1, 2018- for Horse Nettle, Perennial Sow Thistle, Quack Grass, Butter Print, Puncture Vine, Cocklebur, Hemp, Shatter Cane, Wild Sunflower, and Palmer Amaranth

2. That each owner and person in the possession or control of any lands in Fremont County, infested with any noxious weeds, including Quack Grass, Perennial Sow Thistle, Canada Thistle, Field Bindweed, Horse Nettle, Leafy Spurge, Perennial Peppergrass, Russian Knapweed, Hemp, any species of Thistle, and Palmer amaranth shall adopt a program of weed destruction described by the Weed Commissioner, which in five years may be expected to destroy and will immediately keep under control such infestations of said noxious weeds.

3. That if the owners or persons in possession/control of any land in Fremont County fail to comply with the foregoing order, the Weed Commissioner shall cause this to be done and the expense of said work, including costs of serving notice and other costs, if any, to be assessed against the land and the owners thereof.

Sheriff Kevin Aistrope met with the board regarding additional costs for the ISICS Radio System. There is a quote from Electronic Engineering for $38,970.69 to move all paging and other items to the state tower. This includes the road department’s equipment. The next quote from Midwest Data is for the installation, connecting, and leasing of fiber optic lines. The amount is $3,500.00 one time for installation and $1,000.00 per month for leasing the lines. There is also a proposal from Eventide for $2,100.00 for additional licenses required for operation of the dispatch radio. There were other possible unforeseen costs such as building permits, structural requirements, and maintaining the road to the tower, which will be done by the state. 

Aistrope presented a resolution for new hire for the new school resource officer/deputy. Motion made by Hendrickson to approve the following resolution.

RESOLUTION NO. 2018-39

BE IT HEREBY RESOLVED by the Fremont County Board of Supervisors this 10th day of July 2018, that the following individual shall be approved as Deputy for the Fremont County Sheriff’s Department, as requested by Fremont County Sheriff Kevin Aistrope.  The effective date of employment shall be July 9, 2018:

Motion made by Hendrickson to allow Sheriff Aistrope to purchase a vehicle for the new deputy/SRO out of the General Fund from his department. The budget will be amended when the payment is received from the schools. Motion carried unanimously.

Casey Moyer, Landfill Director, presented the renewal document for Financial Assurance for Closure/Post Closure Costs. Motion was made by Graham to allow Chairman Hickey to sign the document to approve the costs. Motion carried unanimously. 

In other business, the Recorder’s Monthly Report for June was approved. 

Claims were approved for July 13, 2018

At 9:28 a.m., there being no further business, Hendrickson made a motion to adjourn. Motion carried unanimously.

July 17, 2018:

The Fremont County Board of Supervisors met in regular session on Tuesday, July 17, 2018, in the Fremont County Courthouse Boardroom, with Graham and Hendrickson present. A quorum was declared, and the meeting officially called to order at 9:00 a.m. The agenda was approved as posted. Minutes of the previous board session were read and approved. Hickey entered the meeting at 9:05. 

Let the records show that Sandy Parmenter from the Valley News Today, Cara Morgan from RC&D and Alise Snyder, Treasurer were present for this meeting. 

Motion made by Hendrickson to approve renewal of Class C Beer Permit, Sunday Sales Liquor License for Pilot Travel Center #238. Motion carried unanimously. 

Motion made by Hendrickson to approve refund of MOJO Sports Bar Liquor License. Motion carried unanimously. 

Motion made by Graham to approve Semi Annual Report. Motion carried unanimously. 

Motion made by Graham to approve the following Resolution 2018-40 Naming Depositories.  

RESOLUTION NAMING DEPOSITORIES 2018-40

RESOLVED, that the Fremont County Board of Supervisors of Fremont County, Iowa, approves the following list of financial institutions to be depositories of the funds in conformance with all applicable provisions of Iowa Code Chapter 12C.

RESOLVED, Alise Snyder, Fremont County Treasurer is hereby authorized to deposit the Fremont County funds in amounts not to exceed the maximum approved for each respective financial institution as set out below:

Motion was made by Hendrickson to allow Chairman Hickey to sign GAX fund request for payment under CDBG for the Iowa Watershed Approach project. Motion carried unanimously.

Cara Morgan from RC&D met with the Board requesting approval of engineering firm for IWA/WMC. Motion made by Hendrickson to approve JEO as the engineering firm for this project. Motion carried unanimously.

Claims were approved for July 20, 2018.

July 24, 2018:

The Fremont County Board of Supervisors met in regular session on Tuesday, July 24, 2018, in the Fremont County Courthouse Boardroom, with Graham present by telephone and Hendrickson present. Hickey was not present for this meeting. A quorum was declared, and the meeting officially called to order at 9:00 a.m. The agenda was approved as posted. Minutes of the previous board session were read and approved. 

Also present for this meeting was Sandy Parmenter with the Valley News Today, Chad Connolly, Mrs. Chad Connolly, Jacob Welchans, Assistant Engineer Robbie Kromminga, and Lloyd Bergantzel.  

Attorney Lloyd Bergantzel and Chad Connolly met with the board regarding a nuisance abatement notice. Connolly had written a letter to the board regarding his property. In the meeting on July 3rd, the board moved to go ahead with the action against Connolly. Attorney Bergantzel stated that Mr. Connolly is working on completing a pole barn on his property to store vehicles. His attorney stated that he would move his vehicles to the property line in the back of his house until he can complete the pole barn. He is waiting for wet conditions to improve so he can finish his building. His attorney requested that Connolly be allowed to move the vehicles to the property line behind the house until completion of his pole barn at which time he will move the vehicles inside. Bergantzel asked if Thanksgiving was a reasonable deadline. County Attorney Bird stated that Connolly should have two weeks to move the vehicles to the property line behind his house. Everyone was in agreeance that Thanksgiving was a reasonable deadline. Both attorneys will talk to the magistrate about a motion to continue this matter. 

Motion made by Hendrickson to sign IDOT Payment Voucher with HGM & Associates for engineering services 06/01/18 through 6/30/18 on Project #STP-S-CO36(75) - - 5E-36. Motion carried unanimously.

The Sheriff’s Monthly Report for June was approved.

July 31, 2018:

The Fremont County Board of Supervisors met in regular session on Tuesday, July 31, 2018, in the Fremont County Courthouse Boardroom, with Hickey and Hendrickson present. Graham was not present for this meeting. A quorum was declared, and the meeting officially called to order at 9:00 a.m. The agenda was approved as posted. Minutes of the previous board session were read and approved. 

Motion by Hendrickson to approve the school resource officer liaison program agreement with Fremont-Mills and Sidney Schools. Motion carried unanimously. 

Purchasing Agent Jeff Shirley met with the board regarding a signing. Motion made by Hendrickson to allow Chairman Hickey to sign work in ROW permit for MidAmerican Energy Company to install a transformer & guy-wire & also installing a span of aluminum overhead triplex above the road at 1710 225th Street. Motion carried unanimously. 

EMC Mike Crecelius met with the board regarding the emergency action plan for the courthouse. He has been working on making changes to the plan for quite some time. He said that they need to hold a security meeting to make additional changes and finalize the plan. The other board members will let Supervisor Graham know that he should call a meeting. 

Jack Reed with INCS met with the board regarding several issues. He presented a final draft of the safety manual. He would like the board to approve the manual at next week’s meeting with an effective date of September 1, 2018. This effective date would allow employees to review the manual and sign off on it. 

Mr. Reed also discussed the rewriting of the secondary roads job descriptions. They are working diligently on these descriptions as they were somewhat outdated. 

He spoke about the union negotiations and new state law. The new law is much more in depth than ever before. He is working with the Kristi O’Neal in the auditor’s office on procedural rules. He has also had contact with the road department and sheriff’s office. He will remain in close contact with the county regarding this matter.
