June 1, 2004:

The Fremont County Board of Supervisors met in regular session on Tuesday, June 1, 2004, in the Fremont County Courthouse, Boardroom, with Hickey, Aistrope and Larson present. A quorum was declared and the meeting officially called to order at 9:00 a.m. The agenda was approved as posted. Minutes of the previous Board session were read and approved.

At 9:00 a.m. Jim Owen met with the Board. Motion was made by Aistrope to authorize Chairman Hickey to sign two Utility Permits for Overhead Construction for Southwest Iowa Rural Electric Co-op for electric distribution line on 130th St from 390th Ave to 400th Ave and electric distribution line on 170th St from 410th Ave to 400th Ave. Larson, aye; Aistrope, aye; Hickey, aye.

At 9:30 a.m. Assessor Karen Berry met with the Board in regards to salaries. Judy Crain and Margaret Henkle were present. Assessor Berry asked if everyone received a 2% raise for next fiscal year. Hickey said no. The union contracts were negotiated separately and the General Relief department was merged with the Mental Health department to save money. Hickey said the 2% was the elected officials increase. Aistrope said we no longer have a General Assistance Director as that position was eliminated and the CPC Director is now Community Services/CPC Director. Hickey said they took into consideration everything that transpired when the department of mental health and general relief were combined into Community Services and I think we used good judgment. The General Relief Director would have been a part-time position with no benefits. In order to keep benefits, a part-time position opened as case manager so the position that was eliminated changed to part time general relief and part time case manager as a full-time position with benefits. Later with another resignation by a case manager the positions changed again. Berry said she took on another computer system. Hickey said he realizes changes keep coming as the auditor will have a new voting system and the treasurer will have a new motor vehicle system, but in this case the administrative expense from general basic was eliminated from an entire department and the CPC took on the responsibility. Hickey said the average pay in Iowa for a CPC is $43,293 and the salary for the Community Services/CPC Director for Fremont County was adjusted upward. Larson said the administration costs of over $50,000 for General Relief, coming from the General Basic Fund, was eliminated with the CPC also acting as General Relief Director. Auditor Hunt said the budgeted salary for the auditor, recorder and treasurer for 2004/05 is $36,711. The budgeted salary for the Community Services/CPC Director is $41,000 for 2004/05 and the budgeted salary for the Assessor is $42,448 for 2004/05. Hickey said all salaries will stand and will not be changed.

In other business, the following hand-written warrant was approved: Fremont Co. Sheriff, Supplies, 1000.

At 10:00 a.m. Mary Morse met with the Board in regards to Country Acres Care. A discussion was held in regards to the sale of the property and the lease on the property.

BE IT HEREBY RESOLVED by the Fremont County Board of Supervisors this 8th day of June, 2004, that Connie Baggs be appointed as Deputy Treasurer as approved in Board session minutes for June 8, 2004, with commission to expire December 31, 2006 unless sooner revoked or when said deputy ceases to perform said named duties.

At 9:30 a.m. Attorney Bruce Green telephoned the Board of Supervisors and gave an update in regards to the United States Court of Appeals for Federal Lawsuit Number 03-1498.

June 15, 2004:

The Fremont County Board of Supervisors met in regular session on Tuesday, June 15, 2004, in the Fremont  County Courthouse, Boardroom, with Hickey, Aistrope and Larson present. A quorum was declared and the meeting officially called to order at 9:00 a.m. The agenda was approved as posted. Minutes of the previous Board session were read and approved.

The Board of Supervisors accepted the letter received from County Auditor Lucille Hunt, stating her retirement as an elected auditor. Hunt’s last day as auditor of Fremont County will be June 30, 2004.

At 9:00 a.m. the following resolution was approved.

RESOLUTION NO. 2004-35

A RESOLUTION PROVIDING FOR A PUBLIC HEARING AND PUBLICATION OF NOTICE IN REGARD TO FREMONT COUNTY ASSIGNING A CERTIFICATE OF PURCHASE AT TAX SALE TO THE FOLLOWING:

WHEREAS, the Fremont County Board of Supervisors proposes to assign the following certificate of purchase at tax sale to Greg Alley, Hamburg, Iowa, 51640, for $50.00.

Parcel Number 430430851000000 – LOTS 100 – 102 INC BLK 13 & LOT 108 BLK 15 EAST HAMBURG, in the original town of Hamburg, Fremont County, Iowa, according to the recorded plat thereof. THEREFORE, be it resolved that a public hearing on the foregoing proposal shall be held at 10:00 a.m. on the 24th day of June, 2004, in the Boardroom of the Fremont County Courthouse, Sidney, Iowa, and that the notice of the hearing shall be published as provided by the Iowa Code Section 331.361(2). The Fremont County Auditor is directed to publish a notice of public hearing in the Hamburg Reporter once, at least four days but not more than twenty days before the date of the public hearing.

At 9:20 a.m. the Board discussed extending the lease on Country Acres Care until the property is sold. Morse Enterprises will extend the lease. A press release was prepared with the help of IT Director Arnold Emberton. He is also going to put the sale on the web site.

At 9:30 a.m. on Tuesday, June 15, 2004, the Board of Supervisors, concurring with the County Auditor, held the Official Canvass of Votes cast in the June 8, 2004, Primary Election. A detailed copy of the count of votes was furnished to the Republican Party and the Democratic Party. The Fremont County Board of Supervisors met in regular session on Thursday, June 17, 2004, in the Fremont County Courthouse, Boardroom, with Hickey, Aistrope and Larson present. At 9:00 a.m. County Engineer Dan Davis met with the Board. Motion was made by Aistrope to authorize Chairman Hickey to sign an application for approval of underground construction on county highway right-of-way for Iowa Telecommunications Services Inc. for underground construction of copper telephone cable across 240th Avenue to 1449 240th Avenue and placing a pedestal at the drive. Larson, aye; Aistrope, aye; Hickey, aye.

At 9:20 a.m. Sandie Sillers met with the Board in regards to the contract between Fremont County Board of Supervisors and Morse Enterprises Inc. for the leasing of Country Acres Care. The contract is scheduled to end on June 30, 2004. Motion was made by Larson to extend the lease for an additional 60 days beginning July 1, 2004, and for additional days if agreed upon by both parties, with other areas of the current lease remaining the same. Aistrope, aye; Larson, aye; Hickey, aye.

Motion was made by Aistrope to authorize Chairman Hickey to sign a renewal license for off-premise liquor, wine or beer with Sunday Sales Privilege for the Crossroads Travel Center LLC, Limited Liability Company, Percival, Iowa. Larson, aye; Aistrope, aye; Hickey, aye.

Motion was made by Aistrope to approve the letter sent to MNW Investments, LLC, informing them although the name of ownership has changed for the Waubonsie Ridge Subdivision, the TIF rebate agreement has not changed and that the lots in the subdivision are not considered ag land any longer and the value of the lots are set by the Assessor. At 9:00 a.m. Sandie Sillers requested pre-approval to purchase a vehicle for case management. Motion was made by Aistrope to pre-approve the purchase of the vehicle from Beecher’s in Shenandoah. Larson, aye; Aistrope, aye; Hickey, aye.

Treasurer Judy Crain informed the Board that 151 parcels that were eligible for tax sale were sold on June 21, 2004, with the total dollar value of $59,563.48.

At 9:30 a.m. motion was made by Aistrope to set the election date of September 14, 2004, which is also the date of the school election, for a ‘Change of Use of the School Local Option Election’ for the school districts of Farragut, Fremont Mills and Sidney. Larson, aye; Aistrope, aye; Hickey, aye.

At 9:45 a.m. Ronda Neal met with the Board. She submitted a bid of $2000.00 for the assignment of a tax sale certificate held by Fremont County for parcel number 430430555000000. The Board said a public hearing will be held.

The public hearing scheduled for 10:00 a.m. regarding assignment of certificate of purchase at tax sale to Greg Alley for Parcel Number 430430851000000 was not held because taxes have been redeemed.

The Board evaluated the public purpose served by expending funds to economic development. FREDCO has contributed to employment and population in Fremont County and this in turn reflects on the increase in the tax base for Fremont County. Therefore a motion was made by Aistrope to contribute $6500 to FREDCO. Larson, aye; Aistrope, aye; Hickey, aye.

RESOLUTION NO. 2004-38

RESOLUTION TO DISBURSE FEDERAL FUNDS IN LIEU OF TAXES-

WHEREAS, United States Treasury has issued a check for payment in lieu of taxes for federally owned entitlement land as authorized by public law 97-258 in the amount of $2426.00.

WHEREAS, public law 97-258 states "a unit may use the payment for any governmental purpose."

BE IT RESOLVED, that the Fremont County Board of Supervisors does hereby authorize the Fremont County Treasurer to deposit said funds in Fund 62000 - Property Tax Agency Fund until all taxes have been certified to the Treasurer for collection. At that time, said funds shall first pay outstanding taxes and drainage assessments of United States of America and any remaining funds are to be deposited in the general basic fund.

At 10:00 a.m. Tracy Vanatta met with the Board. Motion was made by Aistrope to authorize Chairman Hickey to sign the Fremont County Public Health Bio-Emergency Plan. Aistrope, aye; Hickey, aye. The plan was discussed and Tracy stated that a lot of work is still in progress. She said they are working on a health alert network and in the near future will be training volunteers to help in emergency. Grant money is used for training.

At 10:30 a.m. motion was made by Aistrope to approve Cigarette Permits for Sapp Bros, Sidney Foods and The Junction. Aistrope, aye; Hickey, aye. Motion was made by Aistrope to approve Beer and Sunday Sales Permits for The Junction. Aistrope, aye; Hickey, aye.

At 10:45 a.m. Dan Davis met with the Board and the following resolution was approved.

RESOLUTION NO. 2004-39

RESOLUTION TO ACCEPT LOW BID AND AWARD CONSTRUCTION CONTRACT

WHEREAS, the Iowa Department of Transportation held a letting for construction projects on June 15, 2004, and

WHEREAS, bids were received for Farm to Market Project FM-CO36(34)--55-36, and

NOW THEREFORE BE IT RESOLVED by the Board of Supervisors of Fremont County that the contract be awarded to Dennis Parking Lot Maintenance, Inc. for the low bid of $50,423.68. The cost of this project shall be paid from Farm to Market funds.
